1. Acceptance of Terms

Welcome to 99ANNA99. These Terms and Conditions ("Terms") govern your use of our website (99anna99.shop) and any orders you place with us.

By browsing our website, placing an order, or messaging us on WhatsApp, you agree to be bound by these Terms. If you don't agree, please don't use our services.

2. Definitions

• "99ANNA99", "we", "us", "our" — refers to the 99ANNA99 brand operated from Kowdiar, Thiruvananthapuram, Kerala
• "Website" — refers to 99anna99.shop and all its subdomains
• "Customer", "you", "your" — refers to the person placing an order or using our site
• "Products" — phone cases, accessories, and related merchandise sold on our Website
• "Order" — a purchase request placed by you through our Website or WhatsApp
• "Custom Order" — any order involving personalised designs (photos, names, cricket fan teams, couple pairs)

3. Eligibility

To place an order with us, you must:

• Be at least 18 years old, or have the consent of a parent/guardian
• Provide accurate contact and shipping information
• Have a valid Indian shipping address — we currently ship only within India
• Have legal capacity to enter a contract under Indian law

We reserve the right to refuse service, cancel orders, or restrict access to customers who violate these Terms.

4. Placing & Accepting Orders

How orders work

When you place an order, you're making an offer to purchase the selected products at the listed price. We accept your offer only when we dispatch the order — not when you click "Place Order".

We reserve the right to refuse or cancel any order before dispatch at our discretion, including but not limited to:

• Errors in product pricing or descriptions on our site
• Unavailability of the product or phone model
• Suspicion of fraudulent activity
• Custom order content that violates our content policy (see Custom Orders)
• Delivery to a non-serviceable pincode

If we cancel an order, we'll notify you via WhatsApp or email and refund any amount paid (if UPI was used).

Modifying or cancelling your order

You may request order modifications or cancellations within 12 hours of placing the order, subject to dispatch status. Custom orders become non-cancellable once we begin printing.

5. Pricing & Payment

Our pricing

• All prices are in Indian Rupees (₹ INR) and include applicable taxes
• Shipping is free on orders above ₹299; below that, a flat ₹40 shipping fee applies
• We reserve the right to change product prices at any time, but price changes do not apply to orders already accepted
• Prices displayed on our Website are the current price — we do not use unsupported "original" or "MRP" price claims

Payment methods

• Cash on Delivery (COD) — default for all orders; pay cash to the delivery partner when your parcel arrives
• Optional UPI after order confirmation — after placing the order, message us at +91 97723-78346 with your Order ID; we share UPI details for direct payment

We do not currently accept credit cards, debit cards, net banking, or wallet payments through our website.

COD refusal

Refusing to accept a COD parcel upon delivery, without valid reason, results in round-trip shipping costs for us. Repeated COD refusals may result in your phone number being blocked from COD orders.

6. Shipping & Delivery

See our dedicated Shipping Policy for full details. Key points:

• Delivery target: 7–10 days to most Indian pincodes
• Remote pincodes: 12–14 days
• Delivery timelines are targets, not guarantees — actual times depend on courier operations
• Risk of loss and title transfer to you once the courier partner takes possession
• Delivery tracking shared via SMS and WhatsApp on dispatch day

7. Custom Orders — Special Rules

Content you upload

When you upload photos, images, or text for a custom case, you confirm that you own the copyright or have legal permission to use the content. You grant us a limited licence to use that content solely for the purpose of printing your order.

We won't print

We reserve the right to refuse any custom order containing:

• Copyrighted characters or artwork you don't have rights to (Disney, Marvel, anime, cartoons, etc.)
• Celebrity photographs used in ways implying endorsement
• Sexual, obscene, or explicit content
• Hate speech, violent imagery, or content targeting any community
• Images of minors in unsafe or inappropriate contexts
• Watermarked or stolen images
• Content that violates any Indian law

If we refuse before printing, we'll refund you fully. If we discover a violation after printing (rare), we may cancel the order and retain a partial fee for materials used.

Preview approval

For custom orders, we show you a digital preview of your case. By approving the preview, you confirm the final design. Once approved and printed, custom orders are non-returnable and non-refundable, except for manufacturing defects.

8. Intellectual Property

Our content

All content on our Website — including brand name, marks, design system, illustrations, product photos, written copy, and original artwork — is the intellectual property of 99ANNA99 or our licensors. You may not copy, reproduce, or redistribute our content without written permission.

Third-party trademarks

Your content

When you share content with us (reviews, photos, social media posts tagging us), you grant us a worldwide, royalty-free licence to use that content for our marketing — including on our website, social media, and advertisements. You can revoke this by emailing us.

9. User Conduct

When using our Website or services, you agree not to:

• Use our site for any unlawful purpose
• Upload malicious code, viruses, or harmful scripts
• Attempt to gain unauthorised access to our systems
• Scrape or mass-download our content without permission
• Impersonate another person or provide false information
• Abuse our support team or delivery partners
• Submit fraudulent orders, false return claims, or chargeback abuse

10. Disclaimers & Limitation of Liability

Product disclaimers

• Product images are representative; actual prints may vary slightly based on phone model and material
• We make no warranties that our products are indestructible or offer absolute protection — they're designed for everyday collection protection only
• Colours may appear slightly different due to monitor calibration
• Custom photo prints depend on the quality of your uploaded image

Service disclaimers

• Our website is provided "as is" — we don't guarantee uninterrupted service, error-free operation, or immediate response to every message
• Delivery timelines are targets, not contractual guarantees
• We're not responsible for courier delays, loss, or damage in transit (we help resolve these in good faith)

Limitation of liability

To the fullest extent permitted by Indian law, our total liability to you for any claim arising from our products or services is limited to the amount you paid for the specific order. We are not liable for indirect, incidental, or consequential damages.

11. Termination

We may suspend or terminate your ability to order from us if you violate these Terms. You may stop using our services at any time. Termination does not affect any orders already placed or any obligations arising before termination.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes will be subject to the exclusive jurisdiction of courts in Thiruvananthapuram, Kerala, India.

Before filing any legal action, we encourage you to first contact us in good faith — most issues can be resolved directly through WhatsApp or email within a few days.
